Professional Negligence

When you engage the services of a professional, such as an architect, accountant, solicitor, vet, surveyor, or independent financial adviser, you expect the work to be carried out properly on your behalf. Sadly however things do not always go to plan.

When a professional fails to perform his or her responsibilities to the required standard, it is known as professional negligence.

Professional negligence occurs when a client is owed a duty of care by a professional, can demonstrate that the professional breached that duty of care and that this breach caused a loss to the client.

The fact that an error has occurred will not necessarily mean that the professional has been negligent.

In most professional negligence cases, a time limit of 6 years from the date of the negligence will apply, however, in certain circumstances other time limits will apply.
