A couple who purchased a mansion in London have successfully claimed a refund after discovering the property was infested with moths. The couple, who bought the mansion in 2024, were shocked to find extensive damage caused by moths throughout the property.
The mansion, located in a prestigious area of London, was initially marketed as a luxurious and well-maintained home. However, upon moving in, the couple noticed signs of moth infestation, including damaged carpets, curtains, and furniture. Despite their efforts to address the issue, the infestation persisted, leading them to seek legal recourse.
The couple's solicitor argued that the sellers had failed to disclose the infestation, which constituted a significant defect in the property. The case was heard at the Central London County Court, where evidence was presented showing the extent of the damage and the couple's attempts to resolve the issue.
In their defence, the sellers claimed that they were unaware of the infestation and had taken reasonable steps to maintain the property. However, the court found that the sellers had not conducted adequate inspections and had misrepresented the condition of the mansion.
Awarding the couple a full refund, the court emphasised the importance of transparency in property transactions and the need for sellers to disclose any known defects. The couple expressed relief at the outcome, stating that the refund would allow them to find a new home free from such issues.
